Terms of Use & End User License Agreement
Last updated: October 13, 2026
These Terms of Use ("Terms") are a binding agreement between you and The Pew Estate LLC, a Florida limited liability company ("we," "us"). They govern your use of the Zenith app and these web pages (together, "Zenith"). These Terms also serve as Zenith's End User License Agreement (EULA) on the Apple App Store and Google Play. By downloading or using Zenith, you agree to these Terms. If you don't agree, don't use Zenith.
These Terms include, by reference, the following policies:
1. Who can use Zenith
Anyone may use Zenith. If you are under the age of majority where you live, use Zenith only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf. Zenith has no accounts and needs no sign-in.
2. License to use the app
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use Zenith on devices you own or control, for your personal, non-commercial use, subject to these Terms and the usage rules of the app store you got it from. You may not:
- copy, modify, or create derivative works of Zenith, except for the third-party data and code that is licensed to you directly under its own terms (see Data & Credits);
- reverse engineer, decompile, or try to extract its source code, except where the law allows;
- rent, lease, sell, sublicense, or redistribute Zenith;
- use Zenith for anything illegal, including trespassing.
3. Astronomy and weather information
The positions of the stars, planets, Sun, and Moon, rise and set times, twilight times, the sky-quality score, and the weather forecast in Zenith are calculations and estimates. They are made for enjoying and learning about the night sky. They may be inaccurate, and your phone's location, clock, and compass can make them more so. Do not rely on Zenith for navigation, safety, scientific, professional, or commercial purposes.
4. Your safety
Read the Safety & Accuracy Disclaimer; it is part of these Terms. In particular, never look at the Sun, and never use Zenith while driving or walking somewhere unsafe. You are responsible for where you go to observe and for following the law, including rules about private property and public parks at night.
5. Third-party data and services
Zenith uses star, constellation, and astronomy data and fonts made by others, under their own licenses, listed on the Data & Credits page. The weather forecast comes from Open-Meteo, and place names come from Apple or Google, under their own terms. We are not responsible for those services or for their availability.
6. Our intellectual property
Zenith, including its software, design, icons, and the Zenith name, belongs to The Pew Estate LLC and is protected by law, except for the third-party materials listed on the Data & Credits page. These Terms do not give you any rights to our names or logos.
7. Updates and availability
We may update Zenith, change or remove features, or stop offering it. Some updates may be needed for Zenith to keep working. Updates are covered by these Terms unless they come with different terms.
8. Termination
You can stop using Zenith at any time by deleting it. If you break these Terms, your license ends automatically. Sections 3, 4, 5, and 9 through 14 continue to apply after your license ends.
9. Disclaimer of warranties
Zenith is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that Zenith will be error-free, uninterrupted, or accurate.
10. Limitation of liability
To the fullest extent allowed by law, The Pew Estate LLC and its owners, contractors, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, eye damage, property damage, or other loss arising from your use of, or reliance on, Zenith. Our total liability for any claim is limited to the greater of the amount you paid for Zenith in the 12 months before the claim or US $50.
11. Indemnity
You agree to defend and hold harmless The Pew Estate LLC and its owners and contractors from claims arising from your use of Zenith in breach of these Terms or the law.
12. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. Before filing a claim, you agree to email [email protected] and try to resolve it informally for 30 days.
13. Changes to these Terms
We may update these Terms. We will post the new version here and update the date above. If a change is significant, we will also say so in the app's release notes before it takes effect. Continuing to use Zenith after that means you accept the updated Terms.
14. General
These Terms are the entire agreement between you and us about Zenith. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may transfer them as part of a merger, acquisition, or sale of assets.
15. Apple App Store terms
If you downloaded Zenith from the Apple App Store, these additional terms apply:
- Parties. These Terms are between you and The Pew Estate LLC only, not Apple. The Pew Estate LLC, not Apple, is solely responsible for Zenith and its content.
- Scope of license. Your license is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Zenith may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. The Pew Estate LLC is solely responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for Zenith.
- Warranty. The Pew Estate LLC is solely responsible for any product warranties not effectively disclaimed. If Zenith fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for Zenith.
- Product claims. The Pew Estate LLC, not Apple, is responsible for any claims relating to Zenith or your use of it, including product liability claims, claims that Zenith fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
- Intellectual property. If a third party claims that Zenith or your use of it infringes their intellectual property rights, The Pew Estate LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints, or claims: The Pew Estate LLC, 13200 NW 43rd Avenue, Unit F, Opa-locka, Florida 33054; [email protected].
- Third-party terms. You must comply with applicable third-party terms, such as your wireless data service agreement, when using Zenith.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
16. Google Play
If you downloaded Zenith from Google Play, the Google Play Terms of Service also apply to your download. If they conflict with these Terms about the download itself, Google's terms control.
